Real Estate Legal Fees:

Our fees for real estate are fixed at a flat rate. This means that unlike some law firms we do not charge to review your Agreement of Purchase and Sale nor do we surprise you by charging extra at an hourly rate in the event there is any issue with your transaction. We recognize that most of our clients have busy work and family commitments. For this reason, we offer evening appointments for real estate to accommodate your availability.

 

What to expect in a transaction:

We began every new retainer by meeting with the client personally to review a copy of the Agreement of Purchase and Sale. Thereafter, you can expect that we will:

Buying a home

  • Discuss how you wish to take title
  • Communicate with you, your financial institution and the vendor’s lawyer with respect to closing
  • Conduct title searches to ensure there are no liens or encumbrances on title or other issues that may be problematic
  • Obtain title insurance for your new home
  • Review all utility and tax statements and other adjustments to ensure you are paying the proper amount
  • Prepare documents for closing
  • Meet with you to discuss closing and to sign all closing documentation
  • Conduct closing
  • Provide you with a detailed report of the transaction

Selling a home

  • Communicate with you, your financial institution and the purchaser’s lawyer with respect to closing
  • Review all utility and tax statements and other adjustments to ensure you are paying the proper amount, prorated to the date of closing
  • Prepare documents for closing
  • Conduct closing
  • Discharge and payout any outstanding mortgages or lines of credit
  • Provide you with a detailed report of the transaction

Survivorship Application

If two individuals hold title to a property as “joint tenants,” it may be necessary to complete a Survivorship Application in the event one owner dies. There are various complications that may arise for the survivor and his or her estate if the Survivorship Application is not carried out. We offer a flat fee of $500.00 for Survivorship Applications plus disbursements and H.S.T.

Transfers of Title

We regularly transfer title for clients. Commonly, we act for spouses who have separated and have agreed that one spouse will take title to the former family home as part of a settlement. We offer a flat fee of $390.00 for a title transfer plus disbursements and H.S.T.

Mortgage Remedies and Enforcement

When a mortgagor defaults, there are several options open to the lender. The available courses of action may include for instance selling the property by power of sale or obtaining title to the property in a foreclosure action. If you hold a mortgage that is in arrears, Allan Law can help. There is no interim billing for mortgage enforcement as our legal fees are typically paid by the homeowner at the time of collection.

Real Property Litigation

Most real estate transactions proceed smoothly to closing.  However, in some case, transactions do not close or there are issues between purchasers and vendors that arise after closing, such as latent defects which were not disclosed.

We act for sellers and purchasers in real estate litigation claims involving the following:

  • Failure to close a transaction (breach of Agreement of Purchase and Sale)
  • Latent defects (problems that were discovered after the closing that could not have not have been discovered by a property inspector prior to closing)
  • TARION warranty claims
